Terms of Service

Agreement: By using RetroTechCanada's services, you agree to these terms. Please read them carefully before proceeding with any service requests.
1. Service Description
RetroTechCanada provides vintage computer and retro technology restoration services, including but not limited to:
- Computer system diagnostics and repair
- Vintage console restoration
- Custom retro computer builds
- Component sourcing and replacement
- Technical consultation and support
2. Service Agreement Process
2.1 Initial Assessment
All restoration projects begin with a comprehensive assessment including:
- System evaluation and diagnostic report
- Parts availability and cost analysis
- Timeline estimation
- Detailed service quote
2.2 Service Authorization
Work will only commence after:
- Written approval of service quote
- Receipt of required deposit (typically 50%)
- Signed service agreement
3. Customer Responsibilities
- Provide accurate information about equipment condition and history
- Disclose any previous repair attempts or modifications
- Ensure equipment is properly packaged for shipping
- Provide necessary passwords, documentation, or software
- Make timely payments as agreed
4. Pricing and Payment
4.1 Service Fees
- Assessment fee: $75 (applied toward final service cost if work is approved)
- Minimum labor charge: $150 for any repair work
- Parts charged at cost plus 15% handling fee
- Rush service: Additional 25% surcharge
4.2 Payment Terms
- 50% deposit required before work begins
- Balance due upon completion
- Payment methods: Credit card, bank transfer, certified check
- Late payment: 1.5% monthly service charge
Important: Equipment will not be returned until full payment is received. Storage fees of $25/week apply after 30 days.
5. Warranty and Guarantees
5.1 Service Warranty
- 90-day warranty on all repair work and installed parts
- Warranty covers defects in workmanship and part failures
- Does not cover damage from misuse, accidents, or normal wear
- Customer responsible for return shipping costs for warranty claims
5.2 Original Equipment Condition
We make no warranties regarding the original condition or functionality of vintage equipment. Some components may fail during or after restoration due to age.
6. Limitation of Liability
RetroTechCanada's liability is limited to the cost of services provided. We are not liable for:
- Loss of data or software
- Consequential or incidental damages
- Equipment value beyond repair costs
- Delays due to parts unavailability
- Damage to equipment deemed unrepairable
7. Equipment Handling and Risks
7.1 Inherent Risks
Vintage electronics carry inherent risks including:
- Component failure during testing or repair
- Hidden damage or deterioration
- Incompatibility with modern components
- Unrepairable conditions due to obsolescence
7.2 Data Protection
- Customer responsible for backing up all data before service
- We may need to erase or reset equipment during repair
- No liability for lost data, software, or configurations
8. Shipping and Insurance
- Customer responsible for proper packaging and shipping to us
- We provide insured return shipping (cost included in service fee)
- Claims for shipping damage must be made within 48 hours of delivery
- Local pickup/delivery available within 50km at no charge
9. Cancellation and Refunds
9.1 Customer Cancellation
- Before work begins: Full refund minus assessment fee and return shipping
- After work begins: Prorated refund for incomplete work
- After completion: No refund, but return shipping provided
9.2 Service Cancellation by RetroTechCanada
We reserve the right to decline or cancel service for:
- Equipment deemed unsafe or hazardous
- Lack of available parts or technical resources
- Customer non-payment or breach of terms
10. Intellectual Property
- All custom software, documentation, and modifications remain our property
- Customer receives usage rights but not ownership of custom software
- Original equipment and customer data remain customer property
11. Privacy and Confidentiality
We maintain strict confidentiality regarding:
- Customer information and contact details
- Equipment specifications and configurations
- Business or personal use cases
- Technical discoveries or modifications
12. Dispute Resolution
12.1 Governing Law
These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
12.2 Dispute Process
- Direct negotiation between parties
- Mediation through a qualified mediator
- Binding arbitration if mediation fails
- Court proceedings only as a last resort
13. Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, supply chain disruptions, or government restrictions.
14. Modification of Terms
These terms may be updated periodically. Material changes will be communicated to active customers. Continued use of our services constitutes acceptance of modified terms.

15. Acceptance
By submitting equipment for service or requesting a quote, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
